Dog Called As Witness In Murder Trial

March 10, 2005 - Murphy Smith was subpoenaed this week to testify in a murder trial.
Dozens of people were called to testify in the trial of Albert K. Smith.
However, Murphy is different than the other witnesses -- he is the suspect's pet.
Smith apparently wrote the dog letters from behind bars, and that's how his name got on the witness list.
"We're shocked," said the dog's caretaker, Wanda Smith. "Everybody we told said, 'I've never heard of that before.'"
A prosecutor said Murphy "was friendly enough" and likely "would have been a very cooperative witness." But she said the appearance wasn't necessary.
Smith is charged with killing a man who had a relationship with his former wife.
